Job Description
Implement legal action for the non-performing portfolio of the Bank as guided by the Bank’s Policies, Procedures, Processes and existing Laws in order to maintain the Bank’s asset quality in addition to managing litigation risk
Duties, Roles and Responsibilities
- Provide cost-effective and timely legal advisory services and support to the Credit Recovery Function of the Bank in order to foster effective management of regulatory and litigation risk in the execution action to facilitate the recovery of Non-performing loans.
- Co-ordinate the conduct of litigation matters in liaison with External Advocates which includes but is not limited to reviewing pleadings, preparing instructions, supporting Bank witnesses, coordinating hearing dates and providing necessary documents to support timely resolution of the Bank’s cases.
- Represent the Bank in Courts of Law, other fora of Alternative Dispute Resolution and participate in negotiating settlements in liaison with the Bank’s External Advocates and/or the Credit Department.
- Conduct due diligence on non-performing loans forwarded for legal action to support recovery to ensure compliance with the legal regime and Bank Policies and implement the appropriate action.
- Co-ordinate the conduct of due diligence on corporate customers in liaison with external lawyers, which involves receiving requests for account searches from the branch teams, forwarding the requests to external lawyers for verification, receiving and clearing the search reports and/or guiding the branch teams on further actions to be taken.
- Co-ordinate and monitor the implementation of instructions issued to the service providers engaged to support litigation and recovery in accordance with their service legal agreements.
- Maintain schedules of up-to-date litigation, recovery, and account verification cases and prepare relevant reports for Management’s consideration within the required timelines.
- Address external and internal customer queries in accordance to Bank Policy/Service Level Agreement standards and timelines.
- Maintain a record of relevant litigation and recovery correspondences/ files and ensure safe custody thereof.
- Perform any other duties that may be assigned by Management from time to time.
- Financial Responsibility:
- Financial targets on non-performing assets/ written off facilities.
- Financial targets on arrears collections as may be assigned
