Job Description
Review all Trust Deeds, Scheme Particulars, Deeds of Adherence and any other Service Providers’ Agreements to ensure they meet current regulatory benchmarks before execution before submission to the Legal department.
Duties, Roles and Responsibilities
Regulatory Compliance & Fiduciary Oversight
- Statutory Adherence: Monitor and ensure the bank fulfills all statutory duties as a Trustee and Custodian under the CIS and URBRA Acts.
- Document Verification: Review all Trust Deeds, Scheme Particulars, Deeds of Adherence and any other Service Providers’ Agreements to ensure they meet current regulatory benchmarks before execution before submission to the Legal department.
- Licensing & Filings: Coordinate the timely renewal of unit licenses and the submission of mandatory monthly, quarterly, bi-annual and annual returns to regulators.
Risk Management & Internal Controls
- Risk Identification: Maintain the Unit Risk Register, identifying potential operational, credit, and market risks within the Custody and Trustee workflows.
- Process Auditing: Conduct regular “spot checks” on bank processes—such as account opening (KYC/AML), payment authorizations, and trade settlements—to ensure internal procedures are followed.
- Address and resolve any audit and inspection matters relating to Trustee Services.
- Breach Management: Lead the investigation into any compliance breaches, documenting the root cause and monitoring the implementation of rectification plans.
Policy Development & Training
- Procedure Alignment: Update the unit’s Standard Operating Procedures (SOPs) whenever there is a change in the bank’s internal policies or regulations that affect the unit’s operations.
- Staff Sensitization: Conduct regular training for the Investor Services team on AML/CFT, conflict of interest management, and evolving fiduciary laws to foster a “culture of compliance.”
